Japan just moved in the opposite direction from Brussels.
According to legal analysis of the amendments, Japan’s Cabinet has reportedly approved revisions to the Act on the Protection of Personal Information (APPI) that create new conditions for using personal data in AI development and statistical analysis without prior opt-in consent, provided the data poses “little risk” to individual rights. This is a narrowing of the consent requirement that GDPR imposes by default for personal data processing in the EU, where organizations must identify a lawful basis (consent, legitimate interests, or others under Article 6) before processing personal data for any purpose including AI training.
The second is a new regulatory category: “contactable personal information,” covering email addresses and device identifiers. One procedural question that wasn’t resolved: whether APPI amendments require Diet ratification or whether Cabinet approval is sufficient for the amendments to take effect. This is a material gap. If Diet ratification is required, which is standard procedure for Japanese legislation, the effective date and compliance timeline could differ from what Cabinet approval alone would suggest.
