The FCA Model: Regulator-Led Controlled Access
The UK Financial Conduct Authority’s AI Supercharged Sandbox, now in its second cohort, operates on a clear principle: institutions that want to develop and test AI applications in regulated financial services contexts can do so inside a controlled environment where the regulator can observe, evaluate, and learn. The FCA’s announcement of Cohort 2 names Barclays, Experian, and Scottish Widows alongside fintechs Aereve and Coadjute.
The sandbox provides participants with synthetic datasets and specialized compute resources. It gives them structured access to a testing environment they couldn’t build alone, and gives the FCA structured visibility into what participants are actually building.
This is the regulator’s version of tiered access. Institutions inside the sandbox get resources and regulatory clarity that institutions outside don’t have. The FCA gets early sight of AI applications before they reach the market. Both sides accept a level of oversight in exchange for a level of access.
Critically, the FCA model is accountable to a public institutional framework. The FCA is a statutory regulator. Its sandbox exists under legal authority. Its decisions are subject to judicial review. When it decides who gets into Cohort 2, that decision has a governance structure behind it.
The OpenAI Model: Vendor-Proposed Capability Stratification
OpenAI’s reported framework, per Axios, works differently. As described in insider- sourced reporting, the proposal involves two tiers: a publicly available model with standard guardrails, and a more permissive model accessible to vetted government and critical infrastructure operators under a “Trusted Access” framework. A specialized variant described as “GPT-5.4-Cyber” was reportedly demonstrated to Five Eyes and US national security officials.
The stated rationale, as described by the reporting, addresses a real tension in national security AI: the same capabilities useful for cyber offense are useful for cyber defense, and restricting public access doesn’t create a net safety gain if adversaries aren’t similarly restricted. A tiered model attempts to thread this needle by differentiating access by verified identity and use case.
The architecture of restricted AI access has been a recurring theme in frontier AI governance discussions. Who decides which organizations get access to frontier cyber AI is an active policy question, one that several prior coverage cycles have tracked. OpenAI’s reported proposal is one answer to that question: the vendor decides, in partnership with government security agencies.
What’s different about the vendor-led model is the accountability structure, or the question of what that structure is. A vendor deciding who gets “Trusted Access” is a commercial and operational decision. It may align with public safety interests. It may not. The governance mechanisms that would make that alignment reliable, what criteria define “vetted,” who audits the vetting process, what remedies exist if access decisions are wrong, aren’t described in the available reporting.

The premise, differentiated access based on verified identity and accountability – is structurally the same. The legitimacy mechanisms are different. The FCA’s version runs through statutory authority and public accountability. OpenAI’s reported version runs through vendor judgment and government partnership. Both are plausible governance architectures. They produce different accountability distributions.
The Governance Question Neither Answers
The central unresolved question in both models: who decides who gets in, and what accountability exists for that decision?
In the FCA sandbox, the answer is reasonably clear. The FCA decides, per its statutory mandate, and its decisions are subject to the administrative law framework that governs UK financial regulators. Cohort 2 participants were selected by a public body under a published program.
In OpenAI’s reported framework, the accountability structure for vetting decisions is not described in available sourcing. If OpenAI is the primary decision-maker on who qualifies for Trusted Access, that’s a significant concentration of gatekeeping power in a commercial entity. If government agencies are co-decision-makers, questions about oversight, due process, and abuse potential shift to those agencies. For OpenAI’s reported proposal: any official statement from OpenAI, the Five Eyes governments, or US national security agencies. Official confirmation would move this from reported proposal to active policy development. The accountability structure for vetting decisions, if the proposal advances, is the most important governance detail to track.
More broadly: both items reflect a governance direction in which access stratification is becoming a standard tool. The question isn’t whether tiered access frameworks will exist. Several already do. The question is who controls the tiers, under what accountability, and with what remedies when the tiers are misused.
