Two of the world's largest economies built AI governance frameworks in the same year. They took opposite approaches. India published voluntary guidelines grounded in innovation. The EU enacted binding legislation grounded in precaution. Here is what actually differs, what overlaps, and what it means for organizations operating in both jurisdictions.

How Does India AI Governance Compare to the EU AI Act?

MeitY's AI governance guidelines (November 5, 2025) and the EU AI Act (Regulation 2024/1689, in force August 1, 2024) represent fundamentally different answers to the same question: how should a government regulate artificial intelligence? India chose a voluntary, sector-driven framework built on seven principles called sutras. Three governance bodies (AIGG, TPEC, AISI), six context-specific risk categories, enforcement delegated to existing sector regulators. No new AI-specific enforcement body. No AI-specific fines. MeitY PDF

The EU chose binding, horizontal legislation. A new European AI Office, four prescriptive risk tiers, mandatory conformity assessments, CE marking, and fines up to 7% of global annual revenue. These differences produce entirely different compliance obligations for organizations deploying AI. The question for practitioners is not which is superior but what each requires of you.

This is not a matter of one framework being better than the other. They serve different economic contexts, different political priorities, and different institutional capacities. IAPP

Is India's AI Framework Mandatory or Voluntary?

The MeitY guidelines are voluntary. This point deserves emphasis because it is the single most consequential difference between the two frameworks and it is frequently misunderstood. PIB 2025

The guidelines themselves carry no legal enforceability. MeitY has stated this explicitly. No organization can be fined for failing to follow the seven sutras. But that does not mean India has no enforceable AI rules. The enforcement comes from existing statutes:

  • --The IT Act, 2000 governs intermediary liability, data handling, and cybersecurity obligations that apply to AI systems.
  • --The DPDPA, received Presidential assent in August 2023, with operative rules notified November 14, 2025, creates binding obligations for automated decision-making. PIB
  • --Sector-specific regulations from RBI, SEBI, TEC/DoT, ICMR carry their own enforcement mechanisms.

Think of it as soft law layered on hard law. The EU AI Act, by contrast, is itself the hard law. It creates new obligations, new enforcement mechanisms, and new penalties that did not exist before its enactment. Reg. 2024/1689

For organizations assessing compliance risk: India's enforcement exposure is real but indirect, flowing through existing statutes. The EU's enforcement exposure is direct and prescriptive, flowing through the AI Act itself. IAPP

Risk Categories: India vs EU

Risk classification is where the philosophical differences between the two frameworks become operationally concrete. MeitY

India's Six Risk Categories India

MeitY's guidelines define six risk categories that are context-specific rather than prescriptive. The same AI system might fall into different categories depending on the sector, use case, and population it affects:

  • 5.Loss of control -- Autonomous systems beyond intended boundaries
  • 6.National security threats -- AI risks to sovereignty and defense

The determination of which category applies is left to sector regulators and the organizations themselves. There is no exhaustive annex listing specific use cases. This flexibility is intentional. NLR

EU's Four Risk Tiers EU

The EU AI Act defines four risk tiers with specific, enumerated use cases: EU AI Act

  • 1.Unacceptable (Prohibited) -- Social scoring, real-time public biometric ID (narrow exceptions), manipulation of vulnerable persons, emotion recognition in workplaces/education (with exceptions for medical or safety reasons under Article 5(1)(f)). Banned under Article 5.
  • 2.High Risk (Regulated) -- Annex III: biometric ID, critical infrastructure, education, employment, credit scoring, law enforcement, migration, judicial administration. Conformity assessment + CE marking required.
  • 3.Limited Risk (Transparency) -- Chatbots, deepfakes, emotion recognition not covered above. Must disclose AI involvement.
  • 4.Minimal Risk (Unregulated) -- Everything else. No specific obligations.

The EU gives you a checklist: if your system matches a use case in Annex III, it is high-risk, regardless of context. India gives you a framework: assess your system against six categories considering your specific sector, deployment context, and affected population. IAPP

For GCC operations, this means a single AI system may need to be classified under both schemes simultaneously. A hiring algorithm deployed in both jurisdictions is "high risk" under the EU AI Act (Annex III, point 4) and would fall under India's "bias and discrimination" risk domain, with the relevant sector regulator determining specific compliance requirements.

Where They Align

Despite their philosophical differences, the two frameworks converge on several foundational principles. Organizations already compliant with one will find meaningful overlap with the other. IAPP

5 Points of Convergence
  • Accountability. India's functional model (Sutra 5) assigns accountability by role. The EU places primary obligations on the provider. Both demand documented chains of responsibility. MeitY
  • Transparency. India's "Understandable by Design" (Sutra 6) and the EU's Articles 13 and 50 both require disclosure of AI involvement. India frames this as a design principle; the EU as a documentation and labeling requirement.
  • Human oversight. India's "People First" (Sutra 2) and the EU's Article 14 both reject fully autonomous high-stakes decision-making. Art. 14
  • Bias and fairness. India's Sutra 4 and the EU's Article 10 both require bias testing and acknowledge fairness as a governance problem, not just a technical one.
  • Safety. India's Sutra 7 and the EU's Article 15 converge on technical soundness, adversarial resilience, and operational safety.

These convergence points are not coincidental. Both frameworks draw from the OECD AI Principles (2019) and the emerging ISO 42001 standard. The shared DNA means a well-designed AI governance program can address both frameworks simultaneously. ISO 42001

Where They Diverge

The divergences are where compliance programs must differentiate their approach by jurisdiction. IAPP

5 Key Divergence Points
  • Enforcement model. India relies on existing sector regulators within existing mandates. No single AI regulator. No AI-specific penalties. The EU created new institutional infrastructure with power to investigate, audit, and sanction. Penalties reach EUR 35 million or 7% of global annual revenue. Art. 99
  • Risk classification methodology. India's context-specific approach means the same AI system can be classified differently depending on deployment context. The EU's enumerated approach means classification follows use case regardless of context.
  • DPI integration. India's framework assumes AI systems will interact with Digital Public Infrastructure (Aadhaar, UPI, DigiLocker), processing biometric data for over a billion people. The EU has no equivalent concept. IndiaAI
  • Vulnerable population specificity. MeitY's guidelines explicitly name caste-based discrimination, gendered deepfakes, language discrimination across 22 official languages, and child safety. The EU AI Act addresses vulnerable persons in general terms. MeitY
  • Conformity assessment. The EU requires formal assessment for high-risk systems, typically by a third-party notified body, with CE marking. India has no equivalent requirement. PrivacyEngine

India-Specific Risk Concerns

Several elements of India's framework have no parallel in the EU AI Act or any other major AI governance framework. These are not abstract principles. They address documented harms specific to the Indian context. MeitY 2025

4 India-Specific AI Risk Factors
  • Caste bias. India is the only country to explicitly identify caste as an axis of AI bias in a national governance document. Names, addresses, educational institutions, and employment patterns can serve as caste proxies in training data. Standard Western fairness toolkits will not catch these patterns.
  • Gendered deepfakes. The guidelines single out gendered deepfakes (non-consensual synthetic intimate imagery) as a distinct governance concern requiring specific protective measures, not just transparency disclosures.
  • Child safety. Specific protections for minors in AI systems, addressing consent requirements for data processing of children under the DPDPA.
  • Language discrimination. With 22 scheduled languages and hundreds more in active use, AI systems that only function well in English or Hindi may systematically disadvantage other language speakers. The guidelines flag this as a governance concern.

India's DPI ecosystem (Aadhaar, UPI, DigiLocker) is the world's largest digital public infrastructure stack, processing data for over a billion people. IndiaAI The guidelines recognize that AI governance and DPI governance are inseparable in India. The EU AI Act has no equivalent concept. European digital identity frameworks (eIDAS 2.0) are separate from AI regulation.

EU's Unique Features EU

The EU AI Act includes mechanisms India's voluntary framework does not and structurally cannot replicate without binding legislation: EU AI Act

  • --Prohibited practices (Article 5). Specific AI practices banned outright: social scoring, real-time public biometric ID, exploitation of vulnerable groups, subliminal manipulation causing harm.
  • --High-risk annexes (Annex III). Enumerated use cases classified as high-risk regardless of context. Specificity removes ambiguity but reduces flexibility.
  • --Conformity assessment and CE marking. Market-entry requirement for high-risk systems with third-party notified body assessment. PrivacyEngine
  • --General-purpose AI (GPAI) rules. Chapter V creates specific obligations for GPAI model providers: technical documentation, copyright compliance, training content summaries. India's guidelines do not separately address foundation models.

Can ISO 42001 Satisfy Both Frameworks?

ISO 42001 occupies a unique position in this comparison. Both frameworks reference it. Neither requires it. But for organizations operating in both jurisdictions, it may be the most practical compliance tool available. ISO 42001

ISO 42001 as a Jurisdictional Bridge
  • India. MeitY references ISO 42001 in Annexure 6. BIS adopted it as IS/ISO/IEC 42001:2023, giving it national standard status. Certification satisfies the spirit of every MeitY sutra. BIS
  • EU. ISO 42001 sits within the ecosystem of harmonised standards supporting AI Act compliance. Annex A controls map to Article 9 (risk management), Article 10 (data governance), Article 13 (transparency), Article 14 (human oversight), Article 15 (accuracy/robustness). EU AI Act
  • Limitation. Neither jurisdiction gives ISO 42001 a compliance safe harbor. The standard will not give you full AI Act compliance on its own. You still need conformity assessment for high-risk systems. But it provides the management system backbone.
  • Practical value. One management system, one set of controls, one certification. India-specific requirements (caste bias testing, DPI governance, language coverage) and EU-specific requirements (conformity assessment, CE marking, prohibited practice compliance) layer on top as jurisdiction-specific extensions.

This is not theoretical. An organization with ISO 42001 certification can demonstrate to Indian sector regulators that it follows the MeitY guidelines' recommended governance approach. The same certification demonstrates to EU authorities that it has a structured AI management system. ISO 42001

What GCCs Operating in Both Jurisdictions Must Do

Over 1,800 Global Capability Centers operate in India according to the Zinnov-NASSCOM landscape report. Zinnov/NASSCOM Many develop AI systems deployed in the EU market. For these organizations, the regulatory comparison is not academic. It is an operational compliance question.

  1. Classify every AI system under both frameworks. Map each system to India's six risk categories (based on sector, use case, and population) and the EU's four risk tiers (based on Annex III enumeration). Document both classifications. The same system may carry different risk levels in different jurisdictions. Professionals with relevant governance certifications are best equipped to handle this dual-classification work.

  2. Build on ISO 42001 as the common foundation. Implement ISO 42001 as your AI management system. This satisfies India's recommended governance approach and provides the management system structure the EU AI Act expects. Add jurisdiction-specific controls as extensions rather than maintaining parallel systems.

  3. Address India-specific bias risks. Standard EU fairness testing will not cover India-specific bias axes. Build test cases for caste-proxy discrimination, language coverage across your target population, and gendered deepfake risks if your system processes images or video. Document these tests in your ISO 42001 records, and integrate them into your data governance lifecycle processes.

  4. Prepare for EU conformity assessment. If your AI system is high-risk under Annex III (and it may be if it touches employment, credit, or essential services), you need conformity assessment before EU market placement.   5. Monitor both regulatory timelines. India's framework is voluntary now but may not remain so. The phased action plan includes medium and long-term milestones that could introduce binding requirements. The EU's enforcement is phased through August 2027.

  6. Engage both regulatory ecosystems. In India, identify which sector regulator(s) have jurisdiction over your AI systems. In the EU, monitor the European AI Office, your national competent authority, and the development of harmonised standards. Compliance is not static in either jurisdiction.

  • --Indian startups targeting EU expansion. The EU AI Act has extraterritorial reach. If your AI system's output is used in the EU, you are subject to the Act regardless of incorporation.
  • --Compliance and legal teams. EU AI Act compliance requires dedicated budget and potentially notified body engagement. India compliance integrates into existing sector-regulator relationships. Professionals building AI governance careers increasingly need fluency in both frameworks.
  • --Policy researchers and regulators. India and the EU represent the two dominant models for AI governance globally. Other countries are choosing between these approaches or blending elements of both.

The two frameworks are not converging. India and the EU have made different choices reflecting different priorities and institutional capacities. Organizations operating across both jurisdictions must satisfy both. The practical path: build on shared foundations (ISO 42001, OECD AI Principles) and layer jurisdiction-specific requirements on top. ISO
