When AI Companies Self-Restrict Dangerous Models, Who Checks Their Work?

Anthropic and OpenAI have each built cybersecurity AI systems they consider too capable to release broadly, and both have independently created their own vetting frameworks to govern access. No existing regulatory body has authority to review either decision.

Two of the world’s most capable AI labs reached the same conclusion in the same week: their cybersecurity models are too dangerous for general release. That conclusion is theirs alone to make. No agency reviewed it. No framework required it. No oversight body can reverse it.

Anthropic’s Project Glasswing restricts access to Mythos Preview, a model Anthropic’s red team documentation describes as capable of identifying and exploiting zero-day vulnerabilities across every major operating system and web browser, to a consortium of vetted partners. Anthropic is committing up to $100 million in Claude usage credits to the program. Access decisions belong to Anthropic.

OpenAI’s Trusted Access for Cyber takes a parallel approach: a trust-based framework expanding frontier cybersecurity capabilities to a limited set of vetted partners. OpenAI decides who qualifies.

Both programs are responsible industry responses to a genuine problem. They are also entirely voluntary, entirely self-governed, and entirely reversible by the companies that created them.

Why this matters for governance audiences

The governance concern here isn’t that Anthropic and OpenAI made the wrong call. The concern is structural: voluntary self-restriction by frontier AI labs is not a governance framework, it’s a placeholder for one.

Canadian banking executives and regulators convened specifically to discuss the risks posed by Mythos Preview, suggesting the institutional concern is already materializing. That response emerged from the banking sector’s own risk processes – not from any AI governance mechanism that required it.

Security and AI governance experts have broadly noted that advanced capability development without commensurate governance frameworks creates accountability gaps. The specific form those gaps take here is worth naming: who has the authority to require access restriction when a company doesn’t volunteer it? Who reviews whether a company’s partner vetting criteria are adequate? And critically, who is notified if a company decides to loosen restrictions later?

Context and precedent

Voluntary access restriction is not new for dual-use technologies. The pattern in biosecurity, cryptography, and export-controlled technologies is that voluntary industry restraint typically precedes, and often prompts, formal regulatory frameworks. The timeline between “companies decide” and “regulators codify” varies significantly by technology class and jurisdictional appetite.

AI governance frameworks are not silent on dual-use capability. The NIST AI Risk Management Framework addresses high-risk AI deployment contexts, and the EU AI Act’s GPAI provisions place obligations on providers of general-purpose AI models with systemic risk designations. But neither framework was designed for the specific scenario of a lab restricting its own model’s access while simultaneously deploying it to selected partners, the governance gap is real, even if the frameworks provide partial scaffolding.

What to watch

The structural question to track is whether voluntary programs like Project Glasswing and Trusted Access for Cyber become the template, or whether a regulatory body moves to formalize oversight of this class of capability decision. The Canadian banking sector’s institutional response is an early signal that affected industries may push for formalized frameworks before regulators do.
