The deadline is real. August 2, 2026 is confirmed in the EU AI Act’s official implementation schedule as the date when obligations for operators of high-risk AI systems, those listed in Annex III, other than systems covered by Article 111(1), enter into force. Operators: This Regulation shall apply to operators of high-risk AI systems.”
Mark it. Then work backward.
What “High-Risk” Actually Means
The term has a precise legal definition. It’s not a risk rating organizations assign themselves. Annex III of the EU AI Act specifies eight categories of high-risk AI systems, including:
– Biometric identification and categorization – Critical infrastructure management – Educational and vocational training decisions – Employment, worker management, and access to self-employment – Access to essential private and public services (including credit assessment) – Law enforcement applications – Migration, asylum, and border control – Administration of justice and democratic processes
If a system falls into any of these categories, the August 2, 2026 deadline applies. The regulation covers providers, those who develop or place these systems on the market, and deployers, those who operate them in the EU, regardless of where the deployer is based. A US company deploying an employment screening AI that processes applications from EU-based candidates is within scope.
What Compliance Requires Before August 2
The EU AI Act’s obligations for high-risk systems aren’t a single checkbox. They form a compliance architecture. Core requirements include:
*Pre-deployment conformity assessment.* Before a high-risk system goes into production, it must undergo a conformity assessment demonstrating it meets the regulation’s technical requirements. For most Annex III systems, this is a self-assessment procedure supported by technical documentation. Some categories – primarily biometric systems, require third-party assessment.
*Risk management system.* Article 9 requires a documented, iterative risk management process that runs through the AI system’s entire lifecycle. Not a one-time exercise. An ongoing system.
*Technical documentation.* Article 11 requires organizations to maintain detailed technical documentation covering the system’s purpose, design, training data characteristics, performance benchmarks, and monitoring procedures. This documentation must be kept current and available to regulators on request.
*Data governance.* Article 10 sets standards for training, validation, and testing data, including requirements to examine data for biases and implement mitigation measures.
*Human oversight.* Article 14 requires that high-risk systems be designed and deployed so that natural persons can effectively monitor them and intervene. This isn’t just a policy statement. It requires technical implementation.
*Transparency and record-keeping.* High-risk system logs must be kept automatically and retained for a defined period. Deployers must inform users when they’re interacting with a high-risk AI system.
Five months isn’t much time to build all of this from scratch.
Where ISO 42001 Fits In
ISO/IEC 42001:2023 is an AI management system standard, the first of its kind from ISO. It provides a framework for governing AI development and deployment that addresses many of the same areas as the EU AI Act’s organizational requirements: risk assessment, governance structure, documentation, and accountability.
According to isms.online, an ISO 42001 compliance platform, ISO 42001 certification can provide a compliance foundation for EU AI Act Article 17’s quality management requirements. That framing is commercially motivated, isms.online sells ISO 42001 tooling, so treat it as one input, not a definitive assessment.
The broader compliance community’s view is more measured: ISO 42001 addresses organizational governance of AI, which overlaps with but doesn’t replace the technical conformity requirements the EU AI Act imposes. An organization with ISO 42001 certification has built governance infrastructure. It has not necessarily completed a conformity assessment, produced compliant technical documentation for specific Annex III systems, or established the required logging and oversight mechanisms.
Think of ISO 42001 as the governance layer, a foundation. The EU AI Act’s requirements are the technical and procedural layer that sits on top of it. Having the foundation helps. It doesn’t substitute for the structure.
A draft European standard, prEN 18286, is reported to address Article 17’s quality management requirements for high-risk AI providers, according to isms.online. That claim has not been independently verified against official CEN/CENELEC or European Commission standardisation sources and should be treated as preliminary. The Digital Omnibus Variable
EU legislative discussions, including a reported “Digital Omnibus” package, may affect implementation timelines. This is a monitoring flag, not a confirmed development. Compliance teams should not treat it as grounds to delay preparation. Track official EU sources, the European Commission’s AI Act page and the Official Journal of the European Union, for any amendments to the implementation schedule. August 2, 2026 is the operative date until official text says otherwise.
What to Do Before August 2
Compliance teams that haven’t started should prioritize in this order:
1. Scope assessment, identify every AI system your organization develops or deploys that could fall under Annex III. This is the gate. Everything else depends on it. 2. Gap analysis against the technical requirements, Article 9 (risk management), Article 10 (data governance), Article 11 (technical documentation), Article 14 (human oversight), and Article 17 (quality management). 3. Conformity assessment planning, determine whether your systems require self-assessment or third-party assessment. 4. Documentation system design, you’ll need to produce and maintain technical documentation that meets Article 11’s specifications. 5. Governance structure, establish who owns ongoing compliance and how it integrates with your existing risk management and legal functions.
ISO 42001 certification, if your organization is pursuing it, can help structure the governance layer. Don’t let it substitute for the technical work.
The organizations that will struggle in August are the ones that spent the next four months assuming this would sort itself out.
