CLEAR Act and AI Copyright: Who Holds Which Position, and What Compliance Would Actually Require

Bipartisan AI legislation is rare. The CLEAR Act earned it on day one.

PetaPixel confirmed that Senators Adam Schiff, a Democrat from California, and John Curtis, a Republican from Utah, introduced the Copyright Labeling and Ethical AI Reporting Act on March 16, 2026. Two senators from opposite parties, opposite coasts, and constituencies with very different relationships to the creative economy co-sponsoring a bill that targets AI training data is a meaningful signal about where consensus is forming.

The question this deep-dive answers isn’t what the bill is. The daily brief covers that. The question is: who holds which position, and what would compliance actually require?

What the CLEAR Act Would Require

The mechanism is specific. Before releasing an AI model to the public, a developer would submit a formal notice to the Register of Copyrights identifying the copyrighted works used in training. The Copyright Office would reportedly maintain a public database of these disclosures, making the information accessible to rights holders and the public alike.

Two elements make this operationally significant. First, the pre-release filing requirement means compliance happens before commercial availability, not after. There’s no grace period for getting it right post-launch. Second, and more consequentially, the bill applies retroactively. Models already in public release, every large language model currently deployed commercially, would trigger the disclosure obligation for their existing training data.

The public database provision and the civil penalty enforcement mechanism were not available for full independent verification in this package. Both should be treated as reported features of the bill, subject to confirmation against the bill text when available.

Rights Holders: The Intended Beneficiaries

For the creative industries, photographers, writers, musicians, visual artists, the CLEAR Act addresses a specific grievance: the invisibility of their work inside training datasets. Current AI copyright litigation has established that rights holders often can’t prove their work was used because developers don’t disclose training data composition. The CLEAR Act changes the information asymmetry directly.

The retroactive provision is particularly significant here. It gives rights holders visibility into existing models, not just future ones. That’s meaningful for enforcement: a public database of disclosures creates an evidentiary foundation for rights-holder claims that doesn’t currently exist.

Organizations representing creative industries, including those actively involved in AI copyright litigation, are the natural constituency for this bill. Their interest is straightforward: transparency as a precondition for accountability.

AI Developers: The Compliance Burden

The challenge for AI developers isn’t whether they oppose transparency in principle. Most public statements from major AI companies express support for responsible governance. The challenge is operational.

Training datasets for large foundation models are not simple lists. They contain hundreds of billions of tokens sourced from web crawls, licensed data, and curated corpora assembled over years. Reconstructing a comprehensive, accurate inventory of copyrighted works in those datasets is technically complex and, for models already in deployment, retrospectively demanding.

The retroactive application means companies can’t simply comply going forward. They’d need to inventory what they’ve already built. That’s a different order of compliance work than a prospective filing requirement.

The specific penalty structure wasn’t available for verification, but the bill reportedly includes civil penalty exposure alongside rights-holder claims. For companies with models already generating revenue, that exposure is not theoretical.

The broader concern for AI developers involves the relationship between disclosure and competitive IP. A public database of training data composition is also a public map of what data was used, and wasn’t, to build a given model. That has competitive implications beyond the copyright question.

Congress: What the Bipartisan Framing Signals

Schiff and Curtis represent different things to different observers. Schiff’s California base includes both the creative industries concentrated in Los Angeles and the technology sector concentrated in the Bay Area. His co-sponsorship suggests the bill was drafted with awareness of both constituencies. Curtis, a Utah Republican, brings a different signal: conservative support for property rights framing, which is how copyright protection tends to play on the right.

The bipartisan structure is also practical. AI legislation that can be characterized as protecting intellectual property rather than regulating technology has a different path through Congress than bills framed around AI risk or safety. The CLEAR Act’s framing as a transparency and property rights measure gives it cross-aisle appeal that many AI bills lack.

The bill has been introduced. It has no confirmed committee assignment as of March 16, 2026. Legislative prospects are unassessed in this package. Introduction and enactment are different things, the CLEAR Act may advance, stall, or be absorbed into a broader AI legislative package. What the bipartisan sponsorship establishes is that this particular framing of the training data problem has credible political traction.

Where This Fits: Copyright Litigation, Federal Preemption, and the Legislative Landscape

The CLEAR Act doesn’t exist in isolation. AI copyright litigation has been active for over two years, with rights holders in multiple sectors pursuing claims against foundation model developers. Those cases have consistently run into the disclosure problem: proving infringement is difficult when training data composition is opaque.

The CLEAR Act is, in structural terms, a legislative response to that litigation gap. A disclosure regime doesn’t resolve pending cases, but it changes the evidentiary environment for future ones.

It also connects to the broader federal preemption debate covered separately in today’s regulation feed. The federal preemption effort, if it advances, would establish a national AI standard that supersedes state laws. Where IP and copyright disclosure requirements end up in that framework matters. A federal preemption bill that includes CLEAR Act-style provisions looks different from one that doesn’t.

What Compliance Teams Should Watch

The March 18 EU AI Act committee vote is the most time-sensitive item in this cycle. The CLEAR Act has a longer timeline, bill introduction to enactment, if it gets there, involves committee hearings, markup, floor votes, and conference with the House.

Three indicators to watch: committee assignment (signals which Senate committee will shape the bill’s provisions, Judiciary vs. Commerce vs. AI-specific); industry response from major AI companies (their public statements on the bill will signal negotiating positions); and any companion House bill introduction (House companion legislation would signal coordinated strategy rather than a standalone Senate initiative).

If the bill advances to committee hearing, that’s the moment for legal teams to engage the bill text directly and assess the retroactive disclosure obligation against their specific model portfolio.
