Class ACT and the Federal AI Playbook: What USPTO's Agentic Deployment Means for IP Law and the Trademark Backlog

The U.S. Patent and Trademark Office has deployed an AI agent to automate the classification work that precedes trademark examination. That sentence contains two things worth unpacking: "AI agent" in a federal production system, and "automate" applied to work that trademark practitioners bill for. This piece covers what Class ACT actually does, what it means for the practice of trademark law, and what the USPTO's deployment signals for federal AI adoption more broadly.

The trademark application backlog is a real problem. The USPTO processes more than 700,000 trademark applications annually. Before an application reaches a human examiner, it goes through pre-processing: classification into the Nice Classification system’s international classes, design search code assignment under the Vienna Classification, and pseudo mark generation for stylized marks. These steps are structured and rule-governed, but they’re judgment-intensive enough that they’ve historically required human specialist time. They’ve also historically taken time. Months of it.

Class ACT changes that pre-processing step. It doesn’t change what examination requires, the human examiner still reviews the application, assesses likelihood of confusion, evaluates distinctiveness, and makes the substantive call. What Class ACT automates is the preparation work that gets an application queue-ready for that human examiner.

What Class ACT Actually Does

Per the USPTO’s official announcement, Class ACT can immediately assign international classes to unclassified applications and generate the design search codes and pseudo marks that follow. The three functions are technically distinct:

*International class assignment* maps a good or service description to one or more of the 45 Nice Classification classes. This is the most frequently contested classification step, the one where trademark counsel often engage with examiners during the application process.

*Design search code assignment* applies the Vienna Classification to figurative elements in logo marks. It’s highly structured, there are predefined codes for geometric shapes, human figures, animals, and stylized text, but it requires interpreting mark elements visually and consistently.

*Pseudo mark generation* standardizes stylized text elements for search purposes, so that “C0ffee” and “COFFEE” and “Çoffee” can be captured in the same search. This is procedural but consequential, errors here affect prior art searches downstream.

Automating all three at scale, reliably enough to route applications into the examination queue without human re-review, is a meaningful technical claim. The USPTO states Class ACT is expected to reduce classification preparation time from approximately five months to five minutes. That projection is the agency’s own stated expectation, not a measured outcome from production data. The tool is newly deployed. How that projection performs against real application complexity – especially in goods and services categories with ambiguous boundaries, or for marks with complex figurative elements, will take months of data to assess.

What This Means for Trademark Practitioners

The practice impact isn’t where the alarmist version of this story lands. Class ACT doesn’t replace trademark counsel. It automates pre-examination classification prep. But it does shift two things that practitioners should track.

First, the classification conversation. Part of trademark prosecution involves advising clients on how to describe goods and services to maximize classification clarity and minimize office action risk. If Class ACT’s outputs become the baseline against which examiners work, the question becomes: how does Class ACT handle edge cases, and how do those outputs interact with the prosecution strategy a practitioner develops for a client?

Second, the office action rate. If Class ACT’s classification outputs are well-calibrated, they should reduce the volume of identification-of-goods office actions, a significant category of prosecution work. If they’re not well-calibrated, they create a new source of classification errors that practitioners will need to correct during prosecution. The outcome is binary, and it determines whether Class ACT is a net efficiency gain for the IP ecosystem or a new source of friction.

The USPTO’s planned expansion, the agency states it plans to introduce additional AI-enabled trademark tools, suggests Class ACT is positioned as the beginning of a broader agentic AI integration into the trademark process, not a one-time experiment. Practitioners should engage now with what this roadmap looks like in practice, including what transparency the USPTO provides about Class ACT’s accuracy rates.

The Federal AI-in-Production Signal

The USPTO is not a digitally progressive agency by reputation. It runs a 700,000-application workflow through systems that have been modernized incrementally and with significant friction. Deploying an AI agent to production in this environment, not as a pilot, not as an optional tool, but as a live pre-processing system, represents a governance posture that other agencies will watch.

The relevant governance framework here is the NIST AI Risk Management Framework. Class ACT is a narrow, well-defined agentic system operating within structured classification schemas. It’s the kind of deployment NIST AI RMF’s GOVERN and MAP functions were built to address: known inputs, defined outputs, measurable accuracy, auditable decisions. Whether the USPTO is applying the full RMF stack to Class ACT’s deployment, or treating it as a lower-risk tool that doesn’t require the full governance apparatus, isn’t disclosed in available public sources.

That gap is itself a signal. Government AI deployments have a transparency accountability that private sector deployments don’t. When the USPTO reports on Class ACT’s performance, accuracy rates, correction rates, edge case handling, it will set a de facto standard for how federal agencies communicate about production AI tool performance. The absence of that reporting cadence would be notable.

The Displacement Question

Class ACT is the Filter’s clearest example of `ai-direct` workforce displacement in this cycle. The USPTO designed the tool explicitly to automate classification tasks previously performed by human classification specialists. The agency hasn’t disclosed how many roles are affected or what transition support looks like. That’s a disclosure gap that matters, not because the automation is unusual, but because federal agencies operate under different accountability norms than private employers. FOIA-accessible documents and congressional oversight create avenues for transparency that don’t exist in corporate layoff announcements.
