Thirty-one states have introduced AI legislation in 2026. Most follow one of two templates: either a prohibited-use list (no AI in hiring decisions without disclosure, no deepfakes in elections) or an impact-assessment requirement (document the risk before you deploy). Connecticut just introduced a third template.
SB 5’s two-mechanism architecture is what sets it apart. Third-party model verification before deployment. Mandatory disclosure when AI causes workforce displacement. Both in the same bill. Both enforced by the same attorney general. The House passed it 131-17 on May 5, 2026. Governor Lamont has not signed it yet. But the compliance architecture it creates, if it survives, is worth understanding before the ink dries.
What the model verification program actually requires
The first mechanism operates through Connecticut’s Department of Consumer Protection, which would be authorized to approve up to five organizations to serve as official AI model verifiers. The verifiers check AI models against defined safety standards before those models are deployed in consequential applications within Connecticut. The five-verifier ceiling deserves attention. A small, approved roster creates concentration risk. If demand exceeds what five organizations can assess, backlogs develop. The standard against which models get evaluated isn’t yet defined in the public analysis. DCP presumably sets that standard through rulemaking after the governor signs. Compare this to the EU AI Act’s conformity assessment structure. Under Articles 43 and 44 of the EU framework, high-risk AI systems face mandatory third-party assessment before market entry when the system falls into certain Annex III categories. What the workforce disclosure mandate requires
The second mechanism is less technically complex but potentially broader in organizational reach. The bill, per published analyses of its text, would require employers to disclose when AI is a direct cause of layoffs or workforce displacement. Connecticut AG William Tong holds enforcement authority. The provision uses AI as a named causal mechanism, not an inference, not a contributing factor, but a direct cause, which means the compliance question is definitional: what counts as AI causing a displacement?
That definitional gap will likely be litigated. If an employer restructures a department because an AI system now handles 80% of its output, does that qualify? If a workforce planning tool recommends headcount reduction and management follows the recommendation, is that “AI-caused” displacement? These aren’t abstract questions. They’re the exact disputes that will land in front of AG Tong’s office once the law takes effect.
No US state currently has an equivalent provision. Connecticut is working from the other direction: requiring the employer to make the disclosure, then leaving enforcement to the AG rather than individual judicial proceedings.

SB 5’s most significant vulnerability is also its most consequential feature. A state-level pre-deployment gate administered by an appointed roster of verifiers is about as direct a conflict as a preemption argument could ask for.
The existing federal-versus-state tension is already playing out in Colorado and Florida, where the preemption dynamic is active in litigation and legislative negotiation. Connecticut’s SB 5 adds a new front. The key distinction: most state AI laws challenged on preemption grounds have focused on disclosure and prohibited uses, areas where federal preemption arguments are strong but not automatic. A state-administered model certification program touches a different legal category: product safety standard-setting, traditionally a federal domain in analogous regulated industries (medical devices, aviation, pharmaceuticals).
That analogy isn’t determinative, but it is the argument that federal preemption advocates will make. Connecticut’s bill sponsors almost certainly know this. The 131-17 vote suggests the legislature judged the policy value worth the preemption risk.
What deployers must do now
If you deploy AI systems in Connecticut, or employ people in Connecticut and use AI in workforce management, the immediate steps are:
Before the governor signs: Map which AI systems you operate in Connecticut that could fall within the bill’s scope. The specific definition of “consequential application” will come from DCP rulemaking, but starting the inventory now puts you ahead of the timeline rather than behind it.
On model verification: Assess whether your internal AI risk documentation already meets any recognizable safety standard, NIST AI RMF, ISO/IEC 42001, or sector-specific frameworks – so you’re not starting from a blank page when DCP defines its verification benchmark. On workforce disclosure: Work with employment counsel now to define your organization’s threshold for “AI-caused displacement.” Building that definition proactively, before a layoff creates the question in real time, is simpler and cleaner than constructing it after the fact.
On federal preemption: Don’t wait for a court ruling before planning. The preemption outcome is uncertain; the compliance obligation under Connecticut law, if signed, is not. Plan for SB 5 compliance and monitor the preemption litigation as a potential modifier, not a reason to defer.
