OpenAI and Anthropic Are on Opposite Sides of an Illinois Liability Bill. What That Tells Us About AI Safety Strategy.

It's about whether liability protection or mandatory transparency is the correct mechanism for governing catastrophic AI risk, and the answer each company is backing reveals something real about how they're managing their own existential legal exposure.

The Illinois state legislature has become an unlikely stage for one of the more revealing fault lines in AI governance. Two companies that both present themselves as safety-focused, OpenAI and Anthropic, are reportedly taking opposite positions on SB3444, a bill that would shield AI developers from liability for catastrophic harms under specific conditions. One wants the shield. One reportedly wants something harder to satisfy. The gap between those positions isn’t a lobbying accident. It maps onto two fundamentally different theories about how safety governance should work.

What SB3444 Actually Does

The bill creates a liability shield for AI developers when their systems are connected to catastrophic outcomes, defined, per the bill text, as events involving 100 or more deaths or injuries, or $1 billion or more in property damage. Below that threshold, standard liability law applies. Above it, developers who have published safety protocols in advance of the harmful event are shielded from civil suits.

The shield is conditional. It doesn’t protect a developer who ignored safety entirely. It protects one who documented their safety approach before the harm occurred. In design, this resembles the compliance-contingent protections in other high-stakes industries: publish your safety plan, demonstrate adherence, receive reduced liability exposure. The threshold numbers are high enough that everyday AI harms, a bad loan decision, a misdiagnosed medical image, don’t trigger the shield mechanism. This is a framework for tail-risk scenarios: the kinds of AI failures that haven’t happened yet but that regulators are increasingly trying to plan for.

OpenAI’s Position and What It Reveals

OpenAI is lobbying in support of SB3444, per reporting from Wired and Gizmodo. The lobbying effort is reportedly connected to concerns about wrongful death litigation, a framing that comes from journalism covering the bill, not from OpenAI’s stated rationale, and should be understood as an attributed characterization rather than OpenAI’s public position.

Even so, the strategic logic isn’t hard to follow. OpenAI is embedding its models across enterprise, government, and consumer applications at scale. Its operator ecosystem means its models are several layers removed from end users in many deployments. A catastrophic outcome involving a downstream application could generate litigation that travels up the chain to the model developer. A compliance-contingent liability shield, one that rewards documented safety practices, provides a degree of legal predictability that matters when you’re deploying at that scale.

There’s also a market structure dimension. OpenAI has the resources to publish detailed safety protocols. A framework that rewards documented safety practices advantages incumbents who can afford the documentation apparatus. That doesn’t make the framework wrong, but it’s part of the competitive context.

Anthropic’s Reported Position and the Alternative

According to PPC Land, Anthropic is reportedly opposing SB3444 and backing a competing measure, SB 3261, which would require audited public safety plans rather than self-published protocols. This account could not be independently corroborated from higher-tier sources. Everything in this section must be read as reported, not confirmed.

If the reporting is accurate, the distinction between the two frameworks is substantive. SB3444 requires a developer to publish safety protocols, internal documentation, voluntarily disclosed. SB 3261, as described, would require audited plans, documentation reviewed and verified by an independent party. The difference between self-attestation and independent audit is the same difference that separates SOC 1 reports from SOC 2 Type II reports in financial controls: one tells you what a company says about itself; the other tells you what an independent examiner found. In contexts where the harm potential is catastrophic, that distinction matters considerably.

Anthropic’s documented public posture has consistently emphasized independent oversight mechanisms, its Constitutional AI methodology, its Responsible Scaling Policy with external review commitments, its support for third-party evaluation frameworks. If the PPC Land account is accurate, backing an audit-based framework rather than a self-publication framework is consistent with that posture.

Two Theories of Safety Governance

What the Illinois split, reported or otherwise, actually surfaces is a disagreement that runs much deeper than one state bill. There are two coherent theories of how safety governance should be structured for frontier AI systems.

The first theory holds that liability protection, conditioned on compliance documentation, is the right incentive structure. If developers know that published safety protocols reduce their legal exposure, they’ll invest in safety practices to earn that protection. Liability works as a carrot-and-stick mechanism: stick if you don’t document, carrot if you do. This theory is essentially how product liability law works across most industries. It doesn’t require independent verification, it assumes that the threat of liability at the catastrophic end creates sufficient incentive for accurate documentation.

The second theory holds that self-published safety documentation is insufficient as a governance mechanism when the potential harms are severe enough. At catastrophic scale, the argument goes, you need independent verification of safety claims, not because developers are necessarily dishonest, but because the stakes are too high to rely on any single party’s self-assessment. This is the logic behind independent financial audits, nuclear safety inspections, and pharmaceutical clinical trial review. The more severe the potential harm, the more robust the verification mechanism needs to be.

SB3444 operationalizes theory one. SB 3261, as reportedly described, operationalizes theory two. The companies reportedly backing each bill are, perhaps not coincidentally, the ones whose governance approaches most closely resemble each framework.

What Compliance Teams Need to Watch

For legal and compliance teams at AI developers and enterprise deployers, the April 24 committee vote is a near-term data point, not a resolution. Even if SB3444 passes committee and eventually becomes law, the “published safety protocols” standard is undefined with enough precision to create significant interpretive risk. What qualifies? What level of specificity is required? Does a model card suffice, or does the bill contemplate something more operationally detailed?

Those questions matter now, before the bill passes, because organizations building safety documentation programs should understand what standard they might be measured against. A framework designed around SB3444’s self-publication model looks different from one designed around SB 3261’s audited plan model. Betting on the wrong framework in your documentation architecture is a compliance risk.
