Specific enforcement thresholds and maximum amounts haven’t been publicly detailed, but the “equivalent to illicit profits” formula signals a penalty structure that scales with the severity of the violation rather than imposing fixed caps that large enterprises can absorb as a cost of doing business.

Japanese officials have framed the reform as a response to competitive pressure from the United States and China in AI development. Whether that distinction holds under real-world enforcement is a question that depends heavily on how “non-identifiable” gets defined in implementing guidance.
